As AFZ Tekstil Tarım Ürünleri, Madencilik San. ve Tic. A.Ş., we have prepared this Privacy Notice in order to inform our Visitors, Online Visitors, Customers, Potential Customers, Supplier Employees and Supplier Representatives regarding the processing, storage and transfer of their personal data within the scope of our activities arising from the Turkish Personal Data Protection Law No. 6698 (“KVKK”), related legislation and applicable legal regulations.
1) What Categories of Personal Data Do We Process and for What Purposes?
Your personal data may be processed by AFZ Tekstil in accordance with the principles set forth under Article 4.2 of the KVKK, namely:
(i) processing lawfully and fairly,
(ii) being accurate and, where necessary, kept up to date,
(iii) being processed for specified, explicit and legitimate purposes,
(iv) being relevant, limited and proportionate to the purposes for which they are processed,
(v) being retained for the period prescribed by applicable legislation or required for the purpose for which they are processed.
Within the scope of our existing and ongoing business relationships with our business partners, and noting that an individual may fall within more than one category, personal data may be processed for the purposes set out below.
A. Visitors
The identity information of our visitors (e.g. name and surname) and physical premises security information (e.g. CCTV recordings) may be processed for the following purposes:
a) creating and maintaining visitor records,
b) ensuring the security of physical premises.
B. Online Visitors
For online visitors using our website, transaction security information (e.g. IP address) and, where voluntarily provided to us, identity and contact information (e.g. email address) may be processed for the purposes of:
a) conducting activities in compliance with applicable legislation,
b) carrying out information security processes,
c) following up requests and complaints,
d) conducting communication activities,
e) providing information to authorized persons, institutions and organizations,
f) enabling access to our website via the internet.
C. Customers
The identity information, contact information, customer transaction information (e.g. order information), physical premises security information and legal transaction information of our individual customers or representatives and/or employees of our corporate customers may be processed for the purposes of:
a) conducting activities in compliance with applicable legislation,
b) conducting finance and accounting activities,
c) conducting and supervising business activities,
d) conducting logistics activities,
e) providing after-sales support services for goods/services,
f) conducting goods/services sales processes,

i) providing information to authorized persons, institutions and organizations,
j) ensuring the security of physical premises,
k) resolving legal disputes,
l) carrying out storage and archiving activities,
m) conducting risk-management processes,
n) conducting company/product/service loyalty processes,
o) conducting communication activities.
D. Potential Customers
The identity information, contact information, customer transaction information and physical premises security information of potential individual customers or representatives and/or employees of potential corporate customers may be processed for the purposes of:
a) managing goods/services sales processes,
b) conducting contractual processes,
c) ensuring the security of physical premises,
d) conducting marketing analysis activities.
E. Supplier Employees
The identity information, contact information, physical premises security information and professional experience information (e.g. professional training information) of supplier employees may be processed for the purposes of:
a) conducting communication activities,
b) conducting and supervising business activities,
c) ensuring the security of physical premises,
d) conducting supply-chain management processes,
e) conducting logistics activities,
f) conducting activities in compliance with applicable legislation,
g) conducting occupational health and safety activities.
F. Supplier Representatives
The identity information, contact information, physical premises security information, customer transaction information, financial information, marketing information and legal transaction information of individual suppliers or representatives of corporate suppliers may be processed for the purposes of:
a) conducting and supervising business activities,
b) conducting goods/services procurement processes,
c) conducting finance and accounting activities,
d) conducting contractual processes,
e) conducting investment processes,
f) ensuring the security of physical premises,
g) following up and conducting legal affairs.
2) How Do We Collect Your Personal Data?
The categories of personal data listed above are collected through physical means such as order forms, agreements and visitor forms, or through information systems and electronic devices such as telecommunications infrastructure, computers and telephones, third parties such as KKB and Findeks, our website and other documents provided by the relevant data subject, by automated or non-automated means.
3) What Is the Legal Basis for Collecting Your Personal Data?
Your personal data are processed by AFZ Tekstil Tarım Ürünleri, Madencilik San. ve Tic. A.Ş. for the purposes described above on the basis of the legal grounds set out under Article 5 of the KVKK, including:
(i) where processing is expressly provided for by law,
(ii) where processing of personal data belonging to the parties to a contract is necessary, provided that it is directly related to the establishment or performance of that contract,
(iii) where processing is necessary for the data controller to fulfil its legal obligations,
(iv) where processing is necessary for the establishment, exercise or protection of a right,
(v) where processing is necessary for the legitimate interests of the data controller, provided that such processing does not prejudice the fundamental rights and freedoms of the data subject.
4) Do We Transfer Your Personal Data to Third Parties?
a) Personal data belonging to our Visitors may be shared with law-enforcement authorities and judicial authorities where requested under applicable legislation or where necessary for the resolution of legal disputes.
b) Personal data belonging to our Online Visitors may be shared with judicial authorities and authorized public institutions and organizations where requested under applicable legislation or where necessary for the resolution of legal disputes.
c) Personal data belonging to our Customers may, within the scope prescribed by applicable regulations, be transferred to authorized public institutions and organizations for the purposes of conducting activities in compliance with legislation, following up and conducting legal affairs and providing information to authorized persons, institutions and organizations; and may also be transferred to IT service providers, suppliers, cargo companies, insurance companies, banks and our financial adviser. Such personal data may also be transferred to judicial authorities in the event of future legal disputes.
d) Personal data belonging to our Potential Customers may be transferred to judicial authorities in the event of future legal disputes.
e) Personal data belonging to Supplier Employees may, within the scope prescribed by applicable regulations, be transferred to authorized public institutions and organizations for the purposes of conducting activities in compliance with legislation, following up and conducting legal affairs, providing information to authorized persons, institutions and organizations and conducting/supervising business activities; and may also be transferred to IT service providers, suppliers, cargo companies, banks and our financial adviser. Such personal data may also be transferred to judicial authorities in the event of future legal disputes.
f) Personal data belonging to Supplier Representatives may, within the scope prescribed by applicable regulations, be transferred to authorized public institutions and organizations for the purposes of conducting activities in compliance with legislation, following up and conducting legal affairs, providing information to authorized persons, institutions and organizations and conducting/supervising business activities; and may also be transferred to IT service providers, suppliers, cargo companies, banks and our financial adviser. Such personal data may also be transferred to judicial authorities in the event of future legal disputes.
5) Do We Transfer Your Personal Data Abroad?
As AFZ Tekstil Tarım Ürünleri, Madencilik San. ve Tic. A.Ş., we do not transfer your personal data abroad.
6) How Can You Exercise Your Rights Regarding Your Personal Data?
You may submit your requests within the scope of Article 11 of the KVKK, which regulates the rights of data subjects, to AFZ Tekstil Tarım Ürünleri, Madencilik San. ve Tic. A.Ş. by using the Data Controller Application Form available at www.afztekstil.com.tr, prepared for your convenience in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.
